Preamble

This CPM intensive two-week training course provides participants with the knowledge and practical skills required to conduct Road Safety Audits (RSAs) and Road Safety Inspections (RSIs) on new and existing road infrastructure. PREAMBLE

Standard Conditions of Contract are used all over the world in infrastructure projects. These contracts often have technical, legal and commercial implications on the consultants, contractors and project owners who use them. A poorly managed contract will definitely lead to an unsuccessful project. 

Each party to the Contract must know their rights, risks and responsibilities as set out in the Contract. The commercial success of a contractor is largely dependent on how well they understand the provisions of the contract that governs the project. 

A successful Government or public project achieves its intended Time, Cost, and Quality objectives in line with the approved scope and budget. These objectives are reflected in specific provisions of the contract, which guide the planning, execution, and administration of the works. It is therefore essential that all officers involved in project implementation understand the implications of each contractual clause and take timely, coordinated action to ensure proper progress of the works and successful delivery of public infrastructure outcomes.

However, in most public sector bodies or implementing authorities, not all the personnel are well versed with Contracts. Why?
•    “The project team is focusing on construction; the contract is not important for me.” 
•    “The Contract is too complicated, too long and very hard to read.” 
•    “We did not get a full copy of the documents.”
•    “I was not taught about contracts in Finance/Surveying/Architecture/Engineering school”.
•    “That is the Contract Manager’s Job. My job is only to… a-b-c.”

Understanding the Contract enables the Parties to avoid disputes. Disputes are often costly, take time, and spoil good relations. No one likes disputes!
